Renters FAQ - Couryards of Three Fountains
1.) What is Courtyards of Three Fountains?
Courtyards of Three Fountains is a condominium community of individually owned units (not an apartment complex). Each unit is owned by a homeowner who may choose to live in it or rent it to a tenant. Tenants are welcome but are subject to the community’s rules and regulations adopted by the homeowners association (HOA).
2.) What rules do renters have to follow?
All renters must follow the HOA’s Rules & Regulations as well as any leasing rules adopted by the Board found here. These cover behavior, use of common areas, parking, noise, pets, and more — just as they apply to owners. Violations can result in fines.
3.) Are short-term or vacation rentals allowed?
No. Units may not be leased for hotel, transient, vacation, or short-term occupancy and must be leased in their entirety (no partial unit rentals). Short-term vacation rentals (e.g., AirBnB or similar platforms) are prohibited.
4.) Is there a minimum lease length?
Yes. A leased unit must have a lease term of at least six (6) months. Any lease shorter than this is not permitted under the community rules.
5.) What are the occupancy limits?
Occupancy is limited by unit size:
1 bed / 1 bath → up to 2 people
2 bed / 1 bath → up to 3 people
2 bed / 2 bath → up to 4 people
3 bed / 2 bath → up to 5 people
3 bed / 2½ bath → up to 6 people
These limits help ensure safety and reduce overcrowding.
6.) Who is responsible for compliance?
The unit owner (landlord) remains responsible for ensuring that all tenants and their guests comply with HOA rules and for any damage or fines resulting from violations. The HOA may also require certain documentation from the owner regarding tenants.
7.) Do owners have to register their tenants with the HOA?
Yes. Owners must provide the HOA with tenant names and contact information and proof that they conducted the required tenant screening within specified timelines. If this documentation isn’t provided on time, fines can be assessed. (Note: Tenants do not directly register withe HOA - this is done through the owner.)
8.) Do renter leases have to reference the HOA rules?
Yes. All unit leases must be written and state that the tenant agrees to follow the community’s Declaration, Bylaws, and all Rules & Regulations. Failure by the tenant to comply with these documents is treated as a lease default.
9.) What behavior is prohibited?
The HOA prohibits:
Nuisances, unreasonable noise, unlawful, offensive, or disruptive activity.
Destruction of property of any kind, including gates.
Obstruction of common areas (hallways, walkways, driveways).
Unauthorized signs, banners, or displays.
Vehicles inoperable or parked improperly; repairs in parking areas.
Skateboards, scooters, bikes, etc., in driveways and sidewalks.
Any violation may result in fines.
10.) Can tenants have pets?
Pets are allowed only within the limits of the community’s pet rules, which require animals to be household pets, under 35 pounds, leashed, and under control at all times. Pet owners must clean up after their animals immediately, and pets may not be left on patios or balconies unattended.
11.) What about parking?
Each unit has an assigned parking space. Guests should park in designated guest spaces. Vehicles must be operable, properly licensed, and parked appropriately — otherwise they may be towed at the owner’s expense.
12.) Are common areas available to renters?
Yes. Renters are free to use community amenities such as pools and courtyards, but they must follow posted rules at these facilities (e.g., pool gate protocols) and ensure children are supervised.
13.) What about trash and community upkeep?
Tenants must dispose of trash only in the designated dumpster areas and not leave garbage in hallways, patios, or common spaces. Residents are encouraged to help keep common areas clean.
14.) How do I get access to the gate system and gate codes?
Each unit has an assigned gate code that visitors can dial at the entrance gate. Each gate code must be registered to the tenant/owner in order for the system to work. We will need names, telephone, and email address of each tenant to set-up the gate system. The gate code dials the tenant/owner who will open the gate remotely via phone.
15.) What if I have questions or need clarification?
Contact your landlord first for clarification about leasing expectations and compliance obligations. For rules references or HOA contact info, the community website’s Rules & Regulations section contains full guidelines approved by the Board.
